Deputy Prime Minister Belinda Balluku's position in relation to justice has worsened, as it is revealed that the government's number two is also being investigated for a concession in addition to various infrastructure tenders.
According to the SPAK letter, sent to the deputies of the Council of Mandates and Immunity, Balluku risks destroying evidence.
SPAK's reasoning states that the defendant Balluku's free status poses a real risk in the collection of evidence, due to the duty and function he exercises as Deputy Prime Minister of the Republic of Albania and Minister of Infrastructure and Energy.
The letter highlights that there is a possibility that she could intervene and influence the destruction or destruction of evidence or the creation of circumstances that make the collection of evidence difficult, and it is evident that the defendant has already made attempts to influence witnesses.
2. A Member of Parliament may not be arrested or deprived of his/her liberty in any form or have his/her personal or home searched without the authorization of the Assembly.
3. A Member of Parliament may be detained or arrested without authorization when he/she is caught committing or immediately after committing a serious crime. The Prosecutor General and the Head of the Special Prosecution Office shall immediately notify the Assembly, which shall, when it determines that there is no need to proceed, decide to lift the measure.
4. For the matters provided for in paragraphs 2 and 3 of this article, the Assembly may discuss the matter in closed session, for reasons of protection of the accused. The decision shall be taken in open session.
Under these circumstances, it is assessed that the conditions and criteria for replacing security measures exist.
Taking into account the provisions of Articles 228, 229, 230, 237, 238, 260 of the Code of Criminal Procedure, we assess that, after the moment of determining the security measure, the security needs have become aggravated for the person under investigation and the defendant Belinda Balluku, since:
Investigations are being conducted into other criminal facts against this citizen in connection with several other procurement procedures, as well as her actions in a concession procedure;
There are important reasons that put at risk the receipt or authenticity of evidence (We draw attention to the fact that evidence is constantly being administered by various institutions during this investigation, the main documentation is located with the Central Institution headed by this citizen herself, the Ministry of Infrastructure and Energy, various witnesses are being questioned, such as officials, subordinates of this defendant, etc.).
The defendant's free status poses a real risk to the collection of evidence, due to the duty and function she exercises as Deputy Prime Minister of the Republic of Albania and Minister of Infrastructure and Energy. There is a possibility that she may intervene and influence the destruction or destruction of evidence or the creation of circumstances that make the collection of evidence difficult.
