Top Kolshi, suspected of the murder and burial of Enver Bajraktari, in Baicë, Lipjan, at the hearing held on August 13, 2025 at the Basic Court in Pristina, during his statement said that he had no intention of killing the victim and that the victim had been on his property and had attacked him on his property.
According to the Court's decision to impose pre-trial detention, provided by "Oath for Justice", Kolshi stated that he regretted the crime he committed.
" I support my lawyer's words and I add that I feel sorry for the deceased's family and the deceased, I had no reason or intention to kill him and I regret it. He was on my property and he attacked me on my property ," Kolshi is quoted as saying, "Oath for Justice" reports.
The decision states that the defense attorney of the suspect Kolshi, lawyer Halim Shala, has proposed that his client undergo a psychiatric examination.
" We oppose the prosecutor's request for the imposition of a pre-trial detention measure, since this measure has to do with the safety of my client due to the relationships they have with the victim's family since they live in the same place, let it remain as such at this stage with the proposal that during this period a psychiatric examination be conducted for Kolshi, which will objectively verify and argue the state of his mental state, respectively to verify that at the time of committing the criminal offense he was able to understand his actions ," Shala's statement is quoted.
Regarding this, Prosecutor Arben Hoti said that they will take into account the defense's notification regarding the possibility of submitting a request for a psychiatric examination and asked the defense to submit any previous health documents of this nature to the Prosecutor's Office if they possess them.
According to the Court, there is a well-founded suspicion that between August 3 at 4:00 PM and August 4 at 12:10 PM in the village of Baicë - Municipality of Lipjan, the defendant Kolshi, due to prior disputes, intentionally and in complicity with unidentified persons, deprived the now deceased Bajraktari of his life.
It states that Enver Bajraktari, at around 4:00 PM on August 3, left his house to take his cattle to pasture in the village meadows, where he was then hit with hard objects on the head and body, and then suffocated. Then, his body was dragged several meters through a field planted with corn, several corn roots were removed, a hole over a meter deep was dug, the victim's body was placed inside, and then the body was covered with boards.
Always according to the decision, the pit was then covered with soil, and the corn roots were replaced there. Afterwards, the family members searched around the village and on August 4, at 12:10, they found the victim's body with no signs of life.
Therefore, for these actions, Kolshi is suspected of having co-perpetrated the criminal offense of "Aggravated Murder" under Article 173, paragraph 1, subparagraph 1.5 of the Criminal Code.
The decision also states that the analytical report of the security camera footage confirms the fact that the victim was headed towards the place called "corn field", and the defendant's movements initially near the victim's cousin's house and then going to the place called "corn field".
In the decision secured by "Oath for Justice", it is stated that from the statements of witnesses QB, QB, and AB, it is stated that they explained that the victim and the now-defendant had a disagreement 2 years ago and that on the critical day he went out with the cow and did not report it.
Meanwhile, the autopsy report shows that the victim had injuries to his body and that death was caused by suffocation.
Regarding the actions, it is said that Kolshi admitted to the police, as well as at the hearing, that he committed the criminal offense.
Therefore, the Basic Court has concluded that considering that Kolshi has been notified of the ongoing investigations against him, his young age, the criminal nature of the offense, and the fact that he is unmarried, there may be a risk of repeating the offense and fleeing.
The Court also found that based on the gravity of the criminal offense and the circumstances under which Kolshi is suspected of having committed the criminal offense - hiding the dead body which was later found buried, the imposition of a pre-trial detention measure is conditional.
The decision also states that the defendant's criminal past must be taken into account, as it turns out that he has two final convictions, one of which (dated November 25, 2024) concerns a criminal offense against life and limb, in which case it is believed that the victim was the late Bajraktari.
On August 4, the Police announced that a body was found buried in Baica, Lipjan, and that a serious murder was suspected. The following day, on August 5, the Prosecution announced that the body of the victim, who had been reported missing the day before, had been identified. On August 12, it was announced that the suspect, Top Kolshi, had been arrested.
