The Vetevendosje Movement and the Constitutional Court's decision, REL analysis: Will the deadline for the constitution of the Assembly be respected?

The decision of the Constitutional Court of Kosovo, which should have put an end to the months-long institutional crisis due to the impossibility of constituting the Assembly after the elections, has not yet stopped political uncertainty, as the Self-Determination Movement (LVV) has not yet explicitly indicated whether it will respect it.
As Western countries and the European Union demand respect for the August 8 decision, and call for compromise, parliamentary parties have once again come up with opposing positions on it – the LVV criticizes it, while others welcome it.
The Constitutional Court of Kosovo, at the end of last week, ruled that the Assembly of Kosovo must be constituted within 30 days, that the president of this institution must be elected by open vote, and that a candidate cannot be voted for more than three times. The deadline begins to run as soon as the verdict is published in the Official Gazette.
The constitutive session of the Kosovo Assembly began on April 15, but has not ended even after 54 attempts, as the LVV - which won the February elections - proposed Albulena Haxhiu for Speaker of the Assembly, although she was opposed by other parliamentary parties.
On May 1, the chairman of the constitutive session, Avni Dehari, changed the voting method from open to secret, and the creation of a commission to oversee the secret ballot was opposed by other parliamentary parties.
Kurti: Let's wait for the full verdict
The acting Prime Minister of Kosovo, Albin Kurti, who is also the leader of the LVV, on August 11 refused to answer journalists' questions about whether he would respect the Constitutional Court's decision, arguing that he did not have time, as he had another meeting.
On August 12, he briefly said that “we must wait for the full judgment [of the Constitutional Court],” noting that on August 8, the Constitutional Court only gave notice of the decision. However, Kurti again did not clearly specify whether the LVV would respect the decision.
Neither did his cabinet give a direct answer to Radio Free Europe's question a day earlier about whether they would respect the Constitutional Court's decision, but they emphasized that the acting Minister of Justice, Albulena Haxhiu, had provided an answer to this question.
However, Haxhiu, in a press conference on August 10, initially said that the decisions of the Constitutional Court would be respected, but in the same sentence he added that "they must be commented on, they must be opposed, as I am doing here."
What does the international community say?

Nga Ambasada e Italisë në Kosovë, në pyetjen e REL-it për të komentuar qëndrimin e LVV-së rreth vendimit të Gjykatës Kushtetuese, kanë thënë se “të gjitha forcat politike duhet të bien dakord për një zgjidhje për ngërçin aktual institucional dhe politik, për të mirën e Kosovës dhe qytetarëve të saj”.
“Gjykata Kushtetuese ka publikuar sqarime të rëndësishme [për hapat e mëtejmë drejt konstituimit të Kuvendit]. Të gjithë anëtarëve të Kuvendit u bëhet thirrje ta respektojnë këtë vendim dhe të punojnë së bashku në frymën e kompromisit, në mënyrë që të zgjidhen shpejt kryetari i Kuvendit dhe nënkryetarët”, thanë nga Ambasada italiane për Radion Evropa e Lirë.
Nga Ambasada e Francës në Kosovë dhe nga Departamenti amerikan i Shtetit nuk janë përgjigjur në pyetjet e REL-it, ndërsa nga Ambasada e Britanisë së Madhe në Prishtinë kanë kujtuar deklaratën e bërë para shpalljes së vendimit të Gjykatës Kushtetuese më 7 gusht se “aftësia e Gjykatës për të funksionuar në mënyrë të pavarur është me rëndësi jetike për demokracinë e Kosovës. Kjo duhet të respektohet dhe promovohet nga të gjitha palët, ndërsa vendimet e saj duhet të respektohen dhe zbatohen”.
Edhe Zyra e BE-së në Kosovë, më 8 gusht, ka bërë thirrje për kompromis, duke theksuar se nuk ka kohë për bllokadë politike.
Ministrja në detyrë e Drejtësisë, Albulena Haxhiu, më 10 gusht, ka akuzuar një nga gjyqtarët e Gjykatës Kushtetuese, Radomir Llaban, se bashkëpunon me Agjencinë e Sigurisë dhe Informacionit të Serbisë (BIA), duke thënë se këto të dhëna i ka marrë nga institucionet e sigurisë së Kosovës. Ajo ka deklaruar se për gjithçka është njoftuar Gjykata Kushtetuese dhe Prokuroria e Kosovës.
Pak ditë më parë, akuza pothuajse identike për Llabanin kishte bërë edhe presidentja e Kosovës, Vjosa Osmani, duke thënë se ky gjyqtar i Gjykatës Kushtetuese paraqet kërcënim për sigurinë kombëtare të Kosovës. Gjykata Kushtetuese e Kosovës dhe Prokuroria Speciale, deri në publikimin e këtij teksti, nuk i janë përgjigjur pyetjeve të REL-it për këto akuza.
Sipas Gjykatës Themelore të Kralevës, parashkrimi absolut i ekzekutimit të dënimit ndaj Radomir Llabanit, sipas aktgjykimit të formës së prerë, do të ndodhë më 4 qershor 2032. Në vitin 2017, kjo gjykatë i ka dërguar EULEX-it kërkesën për arrestimin e Llabanit, por ky mision i BE-së kishte deklaruar se nuk kishte mandat ta kryente një arrestim të tillë.
Ehat Miftaraj, from the Kosovo Justice Institute, tells Radio Free Europe/Radio Liberty that the public attacks by President Vjosa Osmani and Acting Minister Albulena Haxhiu "clearly undermine the independence and integrity of this judge."
"If there were indisputable evidence and facts that a senior public official poses a threat to constitutional order and national security, the same should be sent to the Prosecutor's Office for criminal proceedings. In democratic societies, which value the rule of law and the principles of good governance, the minister or the president should not resolve national security issues through press conferences," he says.
Miftaraj adds that the LVV, at least in the last four years, has had all the resources and opportunities through law enforcement institutions to investigate and file cases in the prosecutor's office and court, to support public accusations against Llabani, but such a thing has not happened.
"The Vetevendosje Movement has not publicly raised this issue until the recent decision of the Constitutional Court, although it has also made many other decisions that the Vetevendosje has not opposed. Therefore, the recent public accusations can be seen as a political tool against the Constitutional Court, with the aim of reducing its credibility and integrity," he assesses.
LVV's previous requests to the Constitutional Court
Judge Llaban's participation in decision-making has so far not been controversial for the LVV, which itself has addressed the Constitutional Court for clarification.
In June 2020, for example, it requested a review of the constitutionality of the government led by Avdullah Hoti, claiming that the vote of Ashkali Party MP Etem Arifi was invalid because he had been sentenced to imprisonment by a final decision. In early 2021, the Constitutional Court ruled in favor of the LVV and the Hoti government fell, leading the country to elections, which the LVV won and came to power.
Earlier, in April 2020, the LVV had turned to the Constitutional Court for an opinion, attempting to challenge the decree of then-President Hashim Thaçi, by which Avdullah Hoti was appointed prime minister-designate for the formation of the Government.
One of LVV's last requests to the Constitutional Court was in March of this year, when this party requested an assessment of the constitutionality of the Supreme Court's decision, which had rejected its appeal regarding votes from the diaspora./ REL
