From ministries and directorates to agencies or entities, along with independent constitutional institutions... the government proposes changes in the organization of public administration institutions.

The Minister of State for Public Administration and Anti-Corruption has submitted for public consultation the draft law "On the organization and functioning of state administration." Out of the current three, there are expected to be only 2 categories of non-ministerial institutions.  

“The draft law proposes the existence of only two types of non-ministerial/executive bodies, namely the maintenance of classic institutions of dependence, which according to this proposal will also include the current autonomous agencies, and the complete re-conceptualization of the Autonomous Agencies to accommodate the current typology of Regulatory Authorities, by regulating their legal regime of organization and functioning capable of guaranteeing full functional autonomy in the performance of regulatory functions, as required by European legislation for each of the regulators.”

Another innovation of the draft law is related to the accountability system and performance reporting. 

“Upon the approval of the decision on the oversight/accountability system and its implementation, each institution will establish an internal accountability system and draft an Annual Performance Plan and Report. Each ministry will designate for each institution/agency the unit responsible for oversight and will annually engage in the approval of the Annual Plan, oversight and permanent institutional dialogue and the assessment of the institution’s performance, concluding each year with the institution’s performance statement.”

The legal initiative also includes provisions on the minimum number of employees needed to establish a structure in public administration.

"The draft law proposes establishing a minimum threshold of employees that justify the creation of a subordinate institution and the recognition of a new type of directorate with a special status within the ministry apparatus, without legal personality but with increased autonomy based on the delegation of the minister."

The government estimates that the changes will bring greater efficiency and transparency. Most of these proposals are also necessary to align with European Union legislation.
