
New law on public administration! Ministers with the same powers, but the obligation to sign documents is removed

Ministers are expected to be relieved of the burden of responsibility and paperwork, as decision-making will be delegated to the heads of the directorates of various sectors.
The draft law on changes in the functioning of the state administration seeks to transform the responsibility for decision-making in the ministry apparatus and subordinate institutions, towards the directorates, except in cases where there are legal exceptions or when the minister or secretary general expressly decides in writing to bear the responsibility himself.
"The objective is to transfer decision-making to the middle management level of the institution, accompanied by increased responsibility and easing the increased burden on the positions of the minister or secretary general. The purpose of the proposal is to improve the overall work of the institutions, increase efficiency, in particular the quality of decision-making, responsibility for this decision-making, but also the quality of hierarchical control. The officer in charge of the directorate will carry out the preparatory work and will propose the decision-making, the relevant director will make the decision, approving the proposed decision or making a different decision" - Ministry of State for Public Administration and Anti-Corruption.
The public administration is also expected to be reorganized and increase accountability for subordinate institutions, as a fundamental requirement of Albania in the European Union. The institutional typology needs intervention, the draft law explains, which states that international practices are being followed on the basis of legal approximation with the EU; which in the analyses for Albania suggest the non-reporting to Parliament of Independent Regulatory Authorities. Thus, from the three non-ministerial bodies, it is proposed to remain two types, in the first category the subordinate institutions will be maintained together with the current autonomous agencies, while in the second there will be a complete redesign of the Regulatory Authorities and Entities, which will become part of the executive, and will move to monitoring of the work by the Ministries.
'Keeping regulatory authorities outside the government's supervision brings problems in the implementation of the principle of separation of powers, fragmentation of the government's ability/responsibility for drafting and implementing state policies, and a vacuum in the system of government responsibility and accountability.'
Also, the document of the Ministry of State for Public Administration, which is in public consultation, requires restrictions on institutions subordinate to the Prime Minister, because the absence of them has led to overload.
"One of the objectives of the draft law is to facilitate the Center of Government from institutions directly subordinate to the Prime Minister that should or could be transferred to the responsible ministries."
